These terms and conditions of use (hereafter the “TCU”) apply to the Site www.ga-sa.fr (hereafter the “Site”) published by GA, a joint-stock company with capital of €8,044,375.00 registered with the Toulouse Trade Register under no. 428 266 035 whose head office is located at 8, Chemin de la Terrasse, 31 500 Toulouse, France.

II. PURPOSE OF THE SITE 

GA has published this Site in order to provide information to visitors for their personal use. The Site was developed for all web users seeking to familiarise themselves with GA. The content presented may not be wholly or partially used for commercial purposes without prior written consent from GA. 

 

III. INTELLECTUAL PROPERTY ON THE SITE

The entirety of the Site constitutes a work protected by current regulations governing intellectual property. Total or partial use or reproduction of the Site without prior written consent from GA is forbidden.

All graphical elements, images, text, animated sequences with or without sound, logos, and brands represented on the Site are protected by intellectual property laws and are, depending on the case, either the property of GA or of a third party that has authorised GA to use the said content on its site. As such, any downloading, reproduction, representation, adaptation, translation and/or transformation, even partial, or transfer to another site or to any other medium (paper, digital media, video, etc.) without prior express consent from GA is strictly forbidden.

IV. LIABILITY 

The information on the Site may be modified at any time without prior notice. This content is provided to Site visitors purely for informational purposes and is not in any way legally binding.

GA cannot guarantee that the Site will function without interruption and free of errors.

GA is solely bound to a duty of care with regard to operation and continuity of service. GA may not be held liable for any direct or indirect damages resulting from use of the Site, irrespective of their cause; in particular, GA may not be held liable for the alteration of or fraudulent access to data and/or the accidental transmission of viruses. Similarly, GA may not be held liable for occurrences due to force majeure, breakdowns or technical problems involving hardware, software or the Internet network that might lead to the suspension or termination of the service. 

 

V. USE OF PERSONAL DATA

Right to privacy.

GA cares about the right to privacy and the protection of Site users’ personal data.

This Site collects certain personal data. Personal data is defined as data that can be used to identify the physical persons to whom they apply, in any direct or indirect manner:

GA will not use any personal data for purposes other than those described to the Site user at the time of collection.

Use of personal data :

Personal data from Site users is collected and processed in strict observance of the French Act of 6 January 1978 on Information Technology, Data Files and Civil Liberties, amended by the Act of 6 August 2004.

Site users are entitled to access, be informed of, rectify and oppose personal data concerning them collected on the Site. Users may exercise this right by writing to:

VIII. MODIFICATION OF THE CGU

GA reserves the right, at its sole discretion, to change, modify, add or delete all or part of the present TCU at any time. It is the responsibility of Site visitors to regularly consult the TCU. Site visitors acknowledge and accept that any access to or use of the Site as from the date of any modification to the TCU implies explicit and unrestricted acceptance of the new TCU as published on the Site.  

 

IX. APPLICABLE LAW

The Site is governed by French law. All of its content, offers and services are governed by applicable French regulations. Any interpretation, dispute or claim concerning this Site shall be dealt with by the competent French courts.

Should any provision of the TCU be considered to be invalid or declared as such in virtue of any law, regulation or following a permanent decision by a competent court, all other provisions shall remain applicable.
